The NCAA refused Newberry College's appeal because, they school claims, the nickname and logo (Indian face, spear and arrowhead) is meant to be respectful. The NCAA said that the argument misses the point "because it values intent over effect,"
The NCAA also said information gathered from more than 80 tribes and organizations found that Native American nicknames and images should not be used.
Newberry was among 18 colleges barred from using American Indian imagery as mascots, nicknames and logos.
